This Fulfillment Agreement (the “Agreement”) is entered into between GrowthFactor LLC, operating the e-commerce website ElegantAdobe (“Company”), and the customer (“Customer”) who places an order through the Company’s website, www.elegantadobe.us.

1. Definitions

1.1 “Product(s)” refers to the items listed for sale on the ElegantAdobe website.

1.2 “Manufacturer” refers to the third-party entity responsible for producing and/or storing and/or shipping the Products.

1.3 “Order” refers to a purchase request submitted by the Customer through the ElegantAdobe website.

2. Order Processing and Fulfillment

2.1 The Company agrees to process Orders placed by Customers through the ElegantAdobe website.

2.2 Upon receipt of an Order, the Company will promptly transmit the Order details to the appropriate Manufacturer for fulfillment.

2.3 The Manufacturer will be responsible for packaging and shipping the Product(s) directly to the Customer.

3. Shipping and Delivery

3.1 Shipping times and methods may vary depending on the Product(s) ordered and the Manufacturer’s location.

3.2 The Company will provide estimated shipping times on the ElegantAdobe website, but these are not guaranteed.

3.3 The Customer is responsible for providing accurate shipping information.

3.4 Risk of loss and title for Products pass to the Customer upon delivery to the carrier.

4. Returns and Refunds

4.1 The Company’s return and refund policy, as stated on the ElegantAdobe website, will govern all transactions.

4.2 Customers must contact the Company, for all return and refund requests which company will fulfill promptly as it sees fit on case by case basis.

5. Product Quality and Warranty

5.1 The Company will make reasonable efforts to ensure that Products meet the descriptions provided on the ElegantAdobe website.

5.2 Any warranties on Products are limited to those provided by the Manufacturer.

5.3 The Company does not make any additional warranties regarding the Products.

6. Privacy and Data Protection

6.1 The Company will handle Customer data in accordance with its Privacy Policy, as posted on the ElegantAdobe website.

6.2 The Company will share necessary Order information with Manufacturers for fulfillment purposes only.

7. Limitation of Liability

7.1 The Company’s liability shall be limited to the amount paid by the Customer for the Product(s) in question.

7.2 The Company is not liable for any indirect, incidental, or consequential damages arising from the use of its website or the Products.

8. Governing Law and Jurisdiction

8.1 This Agreement shall be governed by and construed in accordance with the laws of Texas, United States.

9. Amendments

9.1 The Company reserves the right to amend this Agreement at any time.

9.2 Continued use of the ElegantAdobe website following any amendments constitutes acceptance of the revised Agreement.

By placing an Order on the ElegantAdobe website, the Customer acknowledges that they have read, understood, and agree to be bound by the terms of this Fulfillment Agreement.

Shipping Policy

What Locations Do You Ship To?

We are currently offering free worldwide shipping on all order. We package & ship  orders to nearly every country across the globe but the transit time will vary from location to location.

How Long Does An Order Take To Arrive Once Shipped?

All orders are processed & shipped as soon as possible through many of our domestic and international warehouses, depending on the fastest shipping method available to your location. We typically take 1-3 business days for handling & processing your order. The typical delivery time frame is anywhere from 5-16 business days. Depending on your location, you might receive items much earlier. Please allow extra time during our busy season as postal delays are out of ourcontrol. Additional factors such as distance, customs, and natural disasters maycause further postal delays.

Tracking information, including the carriers, is provided with every order. Every order is ensured, if your package does not arrive, you are eligible for a refund or replacement. Please reach out to  sales@elegantadobe.com for additional assistance in this matter.

Things to know:

  1. It may take up to 24 hours from the time an item is shipped to the time information is available for viewing.
  2. Once your order ships, transit time is 4 to 13 business days within the 48 contiguous United States, based on shipping location. Deliveries to the USA can take up to 11 business days, depending on the shipping location and clearing customs.
  1. Our free shipping offer can’t apply to all products.
  2. We do not ship on major holidays, including Labor Day, Thanksgiving, Christmas, and New Year’s Day

Will I Receive A Tracking Number For My Package?

Tracking numbers will be sent as soon as we are able to ship your order. Sometimes additional delays may arise that are beyond our control such as postal delays or customs inspections. Thank you for your patience and understanding.

What Do I Do If My Order Is Lost In The Mail?

Each order will be sent with insured shipping & handling to prevent lost packages. If your order happens to get held at customs, lost in transit or returned to us for any reason, we have your back! The postal service is out of our control once your package leaves our warehouse. However, in cases like this, because the packages are insured, we will send you a new package with priority shipping and full tracking, if possible. Please see our refund and return policy for when these might be applicable to shipping situations.

Are There Any Hidden Customs Fees Or Import Taxes?

All prices on our webpage are displayed in USD with all taxes completely covered on our end. However, depending on your location and laws in your area, you may be liable to pay for duties and taxes once you receive your order. Import taxes, duties and related customs fees may be charged once your order arrives to its destination, which are determined by your local customs office. Please seek additional guidance based on your location and the associated import laws. Payment of these charges and taxes are your responsibility and will not be covered by us. We are not responsible for delays caused by the customs department in your country. For further details of charges, please contact your local customs office.

Extended Delays

In some instances, the delivery time may take longer than our policy states. If this is the case, please contact us as soon as possible and we will do everything we can to help you resolve any situation that we have control over.
